Extraterritorial Jurisdiction (ETJ) Release Petitions
The law requires a petition to be filed for Extraterritorial Jurisdiction (ETJ) Release. Requirements for such petition are provided in Section 42.104 of the Texas Local Government Code and Chapter 277 of the Texas Election Code. Petitions must have original wet signatures and be notarized. The City Secretary's Office offers notary services at no charge.
The petition will need to be filed at the City Secretary's Office at 1700 Kohlers Crossing, Kyle, TX 78640. Petitions may be mailed or hand delivered by appointment. There is a fee for this petition - see City's current Fee Schedule.
Below are all the requirements that the City Secretary's Office will be considering with regard to the sufficiency of the ETJ Release Petition:
- Is the petition valid pursuant to Texas Election Code Chapter 277?
☐ Is there a signature on or attached to the petition?
☐ Is the signature in the signer’s own handwriting (i.e., not digital)?
☐ Is the signer’s printed name on the petition?
☐ Is the signer’s date of birth or voter registration number on the petition (does not need both; may be one of these two options to be valid).
☐ If registration number is listed, is the signer eligible to vote in county of residence?
☐ Is the property to be released situated in one county?
☐ If property is in more than one county, is the signer’s county of registration listed?
☐ Is the signer’s residence address listed?
☐ Is the date of signing listed?
☐ Is the date of the first/earliest signature within 180 days from the time the petition was filed?
- Does the petition meet the requirements of Texas Local Government Code Chapter 42?
☐ Is the signature in writing?
☐ Is the petition signed by the required number of people (check the box that applies below):
☐ More than 50% of registered voters of the area as of the date of the last uniform election
☐ A majority in value of the holders of title of land in the area described by petition (i.e., owners of over 50% of the land described)
☐ If land is owned by an entity or group, confirm that signers are authorized signatories for the entity.
☐ Does the petition include a map of the area in the City’s ETJ that is to be released?
☐ Does the petition describe the boundaries of the land in either metes and bounds or by lot and block number?
