REQUEST FOR RELEASE OF FUNDS
On or about 5/11/26, the City of Kyle (City) will submit a request to the Department of Housing and Urban Development (HUD) for the release of 2025 Community Development Block Grant Program Entitlement Funds to undertake a project known as Brent Boulevard Sidewalk Improvements for the purpose of ensuring pedestrian safety and ease of accessibility.

Project Locations:   Sidewalks on both sides of the following streets in the City of Kyle, Hays County, TX:
•    Brent Blvd, from IH 35 S to Philomena Drive (30.003091, -97.862922);
•    Churchill Downs, from Brent Blvd to cul-de-sac (30.002551, -97.863661);

Description of the Proposed Project [24 CFR 50.21 & 58.32]:  Replace existing curb ramps and sidewalks within the same footprint, to be ADA-compliant, and complete associated appurtenances.

FINDING OF NO SIGNIFICANT IMPACT
The City has determined that the project will have no significant impact on the human environment; therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Kyle, 100 W. Center Street, Kyle, TX 78640, (512) 262-1010 and may be examined or copied on weekdays from 8 A.M. to 5 P.M.  The City can also be contacted by email at CDBG@cityofkyle.com.

FINAL NOTICE AND PUBLIC EXPLANATION OF A PROPOSED ACTIVITY IN A
FEDERAL FLOOD RISK MANAGEMENT STANDARD DESIGNATED FLOODPLAIN
This is to give notice that the City of Kyle, under 24 CFR Part 58, has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C, Procedures for Making Determinations on Floodplain Management.  The extent of the FFRMS floodplain was determined using the freeboard value approach.  Project activities will replace sidewalks and ramps in an area that is partially in Shaded Zone X of the 500-Year Floodplain and in Zone AE of the 100-Year Floodplain, all totaling approximately <0.50-acres.  The existing natural and beneficial values of the floodplain will not be adversely affected as project activities will not change the topography, and the sidewalk/ramp improvements will occur in the same footprint. 

The City of Kyle has considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain: Locations: A small percentage of the sidewalk and ramp improvements are located in the floodplain. Removing those areas from the scope of work would eliminate work in the floodplain; however, for the effectiveness of the project, which is to increase pedestrian safety, all of the sidewalks and ramps in the project area must be replaced.   No Action:  Taking no action would incur no costs for improvements and would cause no construction-related environmental impact but would be unable to address the issue of pedestrian safety as residents travel the sidewalks and ramps in the project area.

The City of Kyle has reevaluated alternatives to building in the floodplain and has determined that it has no practicable alternative to floodplain development.  Environmental files documenting compliance with Executive Order 11988 are available for public inspection, review and copying as outlined in the paragraph of FINDING OF NO SIGNIFICANT IMPACT.  

There are three primary purposes for this notice. First, people who may be affected by activities in a floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments/objections on the ERR to the City of Kyle.  All comments received by 5/8/26 will be considered by the City of Kyle prior to authorizing submission of a request for release of funds. Comments must be addressed to the City at CDBG@cityofkyle.com or by mail to: City of Kyle, 100 W. Center Street, Kyle, TX 78640, (512) 262-1010, Attn: Amber Schmeits. Comments should specify which Notice they are addressing.  

ENVIRONMENTAL CERTIFICATION
The City of Kyle certifies to the Department of Housing and Urban Development that Amber Schmeits, in her capacity as Deputy City Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Kyle to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Kyle’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Kyle; (b) the City of Kyle has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the San Antonio Field Office via email at  cpdrrofsan@hud.gov. Potential objectors should contact HUD via email to verify the actual last day of the objection period.

AVISO FINAL Y EXPLICACIÓN PÚBLICA DE UNA ACTIVIDAD PROPUESTA EN UNA
ZONA DE INUNDACIÓN DESIGNADA SEGÚN LA NORMA FEDERAL DE GESTIÓN DEL RIESGO DE INUNDACIONES
Por medio del presente, se notifica que la Ciudad de Kyle, conforme a la Parte 58 del Título 24 del Código de Regulaciones Federales (24 CFR Parte 58), ha realizado una evaluación según lo requerido por la Orden Ejecutiva 11988, de acuerdo con las regulaciones del Departamento de Vivienda y Desarrollo Urbano (HUD) en la Subparte C del Título 24 del Código de Regulaciones Federales (24 CFR 55.20 Subparte C), Procedimientos para la Determinación de la Gestión de Llanuras de Inundación. La extensión de la llanura de inundación de la FFRMS se determinó utilizando el método del valor de margen de seguridad. Las actividades del proyecto reemplazarán aceras y rampas en un área que se encuentra parcialmente en la Zona Sombreada X de la Llanura de Inundación de 500 años y en la Zona AE de la Llanura de Inundación de 100 años, con una superficie total aproximada de <0.50 acres. Los valores naturales y beneficiosos existentes de la llanura de inundación no se verán afectados negativamente, ya que las actividades del proyecto no modificarán la topografía y las mejoras de las aceras y rampas se realizarán en la misma área.

La ciudad de Kyle ha considerado las siguientes alternativas y medidas de mitigación para minimizar los impactos adversos y restaurar y preservar las funciones naturales y beneficiosas, así como los valores intrínsecos de la llanura aluvial existente: Ubicación: Un pequeño porcentaje de las mejoras en aceras y rampas se ubica en la llanura aluvial. Excluir estas áreas del alcance del proyecto eliminaría el trabajo en la llanura aluvial; sin embargo, para la efectividad del proyecto, que busca aumentar la seguridad peatonal, es necesario reemplazar todas las aceras y rampas en el área del proyecto. No intervención: No tomar ninguna medida no generaría costos de mejora ni impacto ambiental relacionado con la construcción, pero no permitiría abordar el problema de la seguridad peatonal de los residentes que transitan por las aceras y rampas en el área del proyecto.

La ciudad de Kyle ha reevaluado las alternativas a la construcción en la llanura aluvial y ha determinado que no existe una alternativa viable para el desarrollo en dicha llanura. Este aviso tiene tres propósitos principales. Primero, las personas que puedan verse afectadas por actividades en zonas inundables y quienes tengan interés en la protección del medio ambiente natural deben tener la oportunidad de expresar sus inquietudes y proporcionar información sobre estas áreas. CERTIFICACIÓN AMBIENTAL

OBJECIONES A LA LIBERACIÓN DE FONDOS
El HUD aceptará objeciones a la liberación de fondos y a la certificación de la Ciudad de Kyle durante un período de quince días a partir de la fecha prevista de presentación o de la recepción real de la solicitud (lo que ocurra más tarde) solo si se basan en uno de los siguientes motivos: (a) la certificación no fue ejecutada por el Funcionario Certificador de la Ciudad de Kyle; (b) la Ciudad de Kyle ha omitido un paso o no ha tomado una decisión o determinación requerida por las regulaciones del HUD en 24 CFR parte 58; (c) el beneficiario de la subvención u otros participantes en el proceso de desarrollo han comprometido fondos, incurrido en costos o emprendido actividades no autorizadas por 24 CFR Parte 58 antes de la aprobación de la liberación de fondos por parte del HUD; (d) otra agencia federal que actúe de conformidad con 40 CFR Parte 1504 ha presentado una determinación por escrito de que el proyecto es insatisfactorio desde el punto de vista de la calidad ambiental. The City of Kyle shall hold a public hearing on a request by John Hall (VR-26-0015) to request the following exceptions from Chapter 41 – Subdivisions of the City’s adopted code of ordinances, regarding detention, drainage, flood mitigation, and sidewalks for property located at 200 Veteran’s Drive, Kyle, TX 78640.

The requested exceptions include:

• An exception from Sec. 41-140 (Watershed and Flood Prevention) to waive requirements for a detention pond and trickle channel.
• An exception from Sec. 41-134 (General Requirements) to allow alternative culvert specifications.
• An exception from Sec. 41-143(a)(1) (Sidewalks) to:
• eliminate installation of new sidewalks along Veterans Drive;
• eliminate sidewalks along Barbee Street (from Woods Street to Veterans Drive);
• waive sidewalk crossings over drainage ditches; and
• reduce the minimum sidewalk width from five (5) feet to four (4) feet.

The Planning & Zoning Commission will hold a public hearing to consider the requests and make a recommendation to City Council on Tuesday, April 14, 2026, at 6:30 p.m.

The City Council will hold a public hearing to consider and render a decision regarding the requested exceptions on Tuesday, May 5, 2026, at 7:00 p.m.

This is to give notice that the City of Kyle (City) has determined that the following proposed action under the HUD Community Development Block Grant Entitlement Program, is located in the floodplain, and the City will be identifying and evaluating practicable alternatives to locating the action within the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988 and in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.  The proposed project location is:

The extent of the FFRMS floodplain was determined using the Freeboard Value Approach and FEMA mapping.  Approximately <0.50-acres of project activities will occur in the 500-Year Floodplain.  The beneficial values of the floodplain will not be adversely affected as the project will not change the topography and best management practices will be utilized during construction.  Elevation requirements will not apply to this non-critical action project.

There are three primary purposes for this notice. First, people who may be affected by activities in the floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts on the floodplain.  Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas.  PY 2025 ANNUAL ACTION PLAN
 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)

The City of Kyle receives Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD). The City prepares an Annual Action Plan outlining how it will allocate funds for the upcoming program year. The total amount of grant funds available for Program Year 2025 (October 1, 2025 – September 30, 2026) is $277,869.

The City of Kyle is proposing a Substantial Amendment to its adopted PY 2025 Annual Action Plan. The originally approved project included first-time sewer line improvements in the Quail Ridge neighborhood. Following additional review of implementation timing, acquisition considerations, and current cost conditions, the City proposes reallocating PY 2025 CDBG funds toward public sidewalk improvements that will serve low- and moderate-income areas within the City of Kyle.

To begin the process of determining funding priorities and activities for this amendment, and to receive public comment, the City is hosting a public hearing. Public comments are welcome at any time during the official comment period to comply with HUD’s minimum 30-day requirement.

CDBG Program Background:
 The national objective of the CDBG program is to develop viable urban communities by providing decent housing, a suitable living environment, and expanding economic opportunities principally for low- to moderate-income persons. Not less than 70% of CDBG funds must be used for activities that benefit low- to moderate-income persons individually or through non-profit agencies or public improvements in low- to moderate-income neighborhoods.

The proposed amendment reallocates funds to public infrastructure improvements that enhance pedestrian safety, accessibility, and mobility in eligible low- to moderate-income areas.

The proposed Substantial Amendment will be available for public review at the following locations:
