Building Services

The Building Inspection Department is responsible for the issuance and inspection of all construction related permits, as well as the issuance of Certificates of Occupancy.

 


Mission

To maintain the health, safety and general welfare of homes and businesses by obtaining compliance with City codes and ordinances through public awareness, education and steadfast vigilance.

Permits

A permit is required prior to the commencement of any construction located on property within the city limits. Activities requiring permits are listed below:

  • New construction (commercial and residential)
  • Remodels (relocation or removal of interior walls, and/or electrical, mechanical, or plumbing)
  • Additions to existing structures
  • Accessory buildings and structures
  • Swimming pools
  • Driveways/culverts
  • Signs (new or re-facing)
  • Demolition
  • Moving structures
  • Water/wastewater connections
  • Irrigation systems

This list is not comprehensive, so please confirm with the Building Inspection Department prior to commencing work.

Building Codes

The City of Kyle, as part of the City's Building Ordinance, has adopted the following building codes:

  • 2021 International Building Code
  • 2021 International Residential Code
  • 2021 International Plumbing Code
  • 2021 International Mechanical Code
  • 2021 International Fuel Gas Code
  • 2021 International Fire Code
  • 2021 International Energy Conservation Code
  • 2021 International Property Maintenance Code
  • 2021 International Swimming Pool and Spa Code
  • 2020 National Electrical Code

These codes can be purchased in their entirety through the International Code Council.

Signage

All signs erected or modified within city limits or the ETJ require the issuance of a Sign Permit as specified in the City's Sign Ordinance.

Code Enforcement

The Building Department also oversees Code Enforcement in the City of Kyle. Code Enforcement is responsible for monitoring both public and private property, commercial and residential, to ensure that there are no health or safety hazards that might endanger the public and determining compliance with all City codes and ordinances.

Frequently Asked Questions

Depending on the type of project, you may be required to obtain a permit and register with the City. Please check with the Building Inspections Department for any requirements regarding the building, mechanical, electrical and plumbing codes and/or any ordinances adopted by the City. If a permit is required, the homeowner must provide proof of homestead to do the work themselves. Some work must be done by a licensed professional. Please see the Building Department Rulings and Procedures page for more information.

Permits are required for the following:

  • New buildings: dwellings, garages, storage sheds, carports, etc.*
  • Window and exterior door replacement.
  • Swimming pools and spas/hot tubs. 
  • Alterations/remodeling: new or relocating plumbing or electrical wiring.
  • Installing or replacing heating and/or air conditioning equipment. 
  • Moving or demolishing buildings. 
  • Patio covers, decks and carports.
  • Installing or replacing a water heater/water softener. 
  • Installing irrigation systems. 
  • Installation of solar panels.

*Residential structures and/or decks under 200 square feet, that are not attached to the dwelling do not require a permit. Decks 30 inches or more above grade are not exempt from permit requirements.

 

Most permits expire 180 days from the date of issuance or the date of your last inspection.

The CSS portal generates an automated due date when a permit is put in the reviewer's queue. Due to the increase in permit applications, we've been receiving, this date is not guaranteed. Permit submittals require a complete application. The applicant and all Sub-Contractors must be added under permit contacts and have a current registration with the City. If the permit requires resubmittal or revisions, the approval will be delayed. We recommend you check your portal often for comments from your reviewer and to make sure all prerequisites are marked passed/complete.

This is a question many people may ask themselves when planning alterations to their home. Our adopted codes are minimum standards intended to provide a reasonable level of health, welfare and safety from fire and other hazards to the citizens of Kyle as well as emergency services responding to incidents in the built environment.

A decision not to get a permit could also be very costly. Some homeowners are finding when they try to sell or refinance their home, prospective buyers or lending institutions want proof that alterations are in compliance with local codes. Without a permit and inspection on record, there is no proof. The homeowner must then apply for a permit with no guarantee that the remodel will meet the codes, and they face the possibility that the remodel must be redone or removed. This is costly and frustrating and could cause delays in refinancing or a lost sale of their home.  Any fire and homeowners' insurance you have may be invalidated if you do work without a permit. If there is a fire in your house, the insurance company may very well use the illegal work as an excuse not to pay on your claim.

Yes, but a permit will likely be required, and it must be installed and comply with the City’s adopted electrical code. If a permit is required, the homeowner must provide proof of homestead to do the work themselves. Some work must be done by a licensed electrician. Yes, the homeowner must provide proof of homestead, get a permit, install an approved backflow assembly and have the assembly tested by a Licensed Backflow Prevention Assembly Tester prior to using the irrigation system. A list of licensed backflow testers who are registered with the City can be found at Vepo. Yes. We will require a permit to ensure the electrical work is done to code. If you are hiring an electrician to do the work, they will need to be registered with the City and they will pull the permit. A homeowner can do their own electrical work but will be required to pull the permit listing themselves as the electrician. All electrical work must conform to code. See the Building Inspections home page for a list of the current codes the City has adopted. The gas company wants to be sure your gas distribution system is safe before they connect their meter, so they require us to inspect the system and that inspection requires a permit. That permit can only be applied for by a State Licensed Responsible Master Plumber. It is his responsibility to check the system for leaks and provide a leak test so we can verify it is safe and free of leaks. As soon as we verify the system is compliant, we will approve the inspection and notify the gas company to release your meter. 

 

A permit is required for most repairs and for all new and replacement equipment installations in the heating, ventilation and air conditioning system. When a permit is required, the contractor must be registered with the City and licensed with the Texas Department of Licenses and Regulation (TDLR) and must obtain the permit before performing any work. When a contractor is doing the work, they must pull the permit because they are doing the work and will be responsible for making sure the work meets code requirements. They are required to be registered with the City. They must also carry and provide proof of liability insurance. Always ask to see the permit before work is started.

Yes, accidental drowning is the number one cause of death for children under the age of 5 in the United States. The City has adopted the International Swimming Pool and Spa Code to ensure all safety parameters are met for these installations. INTERNATIONAL SWIMMING POOL AND SPA CODE (ISPSC)

Accessory buildings require a permit. All accessory structures must not be placed in an easement and must meet set-back requirements. Residential accessory structures under 200 sq ft with no utilities are exempt from permit but still must comply with city ordinances and codes.

No. The general contractor pulls the permit and lists the subcontractors (plumber, electrician, mechanical contractor) that will be working on the project. The subcontractors will, however, need to be registered to work in the City.  If a subcontractor is doing work after the main permit (the permit issued to the general contractor) has been finaled, then the subcontractor would need to pull a separate permit. Yes. The foundation company doing the work must be registered with the City and apply for a permit. Due to the expansive soils in Kyle they must submit an engineered design. Make sure you see the permit before the work is started. At the time of inspection, a sealed letter from the engineer approving the foundation work is required. While your project may be approved by the City, you should check your deed restrictions and HOA requirements before applying for a permit. The City does not enforce HOA restrictions and/or requirements.

A permit is required for any deck over 200 square feet and/or 30 inches above grade and/or attached to a dwelling.

Patio covers that are attached to a dwelling or are over 200 square feet require a permit. For more information on patio cover requirements, contact Building Inspections at (512) 262-3911.

There is no provision in the sign ordinance which would allow for this type of advertising.

You may put directional signs out 24 hours prior to the sale and they must be removed within 24 hours of the conclusion of the sale. These signs must be less than 4 square feet. They cannot be placed on public property or in a public right-of-way. You do not need permits for these signs.

You may have one sign in your yard advertising the sale of your house. You may also have one open house sign at the time of your open house. No permit is required for these signs as long as they are less than 12 square feet. No signs may be placed on public property or in a public right-of-way.

Yes, but the International Residential Code (IRC) has provisions intended to ensure there is access to service the unit and a permit is required. Please contact Building Inspections at (512) 262-3911 for more information.

Yes, the ignition source of a water heater must be elevated at least 18” above the garage floor. This rule is not applicable to water heaters that are listed as flammable-vapor-ignition resistant.

Yes. State law requires the City to perform an inspection of water heater replacements. If you hire a plumber to replace your water heater, they must be registered with the City and licensed with the Texas State Board of Plumbing Examiners. A permit must be obtained before the work is started and it is important to be sure an approved final inspection from the City is obtained. If the permit cannot be obtained before the work is performed due to an emergency or the permit office being closed, a permit must be obtained on the next business day. If a homeowner is to perform the work, they must submit proof of their homestead exemption when they apply for their permit, and all work must comply with the current plumbing codes and ordinances. 

Where a storage tank-type water heater is installed in a location where water leakage from the tank will cause damage, a drain pan with a minimum 3/4 inch drain shall be installed.

Construction working hours are limited to 7 a.m. to 9 p.m. Please contact the City of Kyle’s Code Enforcement Division if you observe work being performed outside of these hours, you can submit a complaint to Kyle 311 via phone, website or app.  Other noise complaints should be directed to the City of Kyle Police Department non-emergency number 512-268-3232
